Gearave Seller Terms

These Gearave Seller Terms (“Seller Terms”) apply whenever you create, publish, manage, promote, or transact through a listing on Gearave, a marketplace service operated by OUTRALLY LLC (“OUTRALLY,” “Gearave,” “we,” “us,” or “our”).
These Seller Terms supplement the OUTRALLY Terms of Service and Privacy Policy. By posting an item for sale or otherwise accepting these Seller Terms, you agree to them. If these Seller Terms conflict with the OUTRALLY Terms of Service regarding your selling activity on Gearave, these Seller Terms control for that selling activity.
1. Seller Eligibility
To post items for sale on Gearave, you must be at least 18 years old, have legal capacity to enter into the transaction, use an account you are authorized to use, provide accurate seller information, and comply with applicable law.
You may not sell through another person’s identity or account to avoid restrictions, suspensions, verification, taxes, reporting, marketplace rules, or legal requirements.
2. Right to Sell
By listing an item, you represent and warrant that you own the item or are legally authorized to sell it, the item is lawfully in your possession, the proposed sale does not violate law, the sale does not violate another person’s ownership, contract, trademark, copyright, patent, or other rights, and the item is not stolen or unlawfully obtained.
We may request information reasonably necessary to verify ownership or selling authority.
3. Listing Accuracy
You are responsible for the accuracy of your listing. You must accurately identify and disclose, where applicable, brand, model, version, specifications, category, condition, significant wear, cracks, damage, repairs, alterations, modifications, authenticity, included accessories, missing components, asking price, availability, location or meetup area, material defects, and other information that would reasonably affect a buyer’s decision.
You may not intentionally conceal material defects.
4. Photographs
Where Gearave requires or permits listing photographs, photographs must accurately represent the item offered. Unless clearly disclosed and appropriate for informational purposes, you should use photographs of the actual item.
You may not use misleading photographs, manipulate images to conceal defects, use another seller’s images without permission, depict accessories that are not included without making that clear, or falsely depict condition or authenticity.
5. Authenticity
You may not list counterfeit goods. You may not describe counterfeit goods as genuine, intentionally use an incorrect brand, misrepresent a replica as authentic, or conceal authenticity concerns that you know would be material to a buyer.
If you are uncertain about authenticity, do not represent the item as verified authentic unless you have a reasonable basis for doing so. Gearave does not guarantee authenticity unless a specific service expressly says that it does.
6. Product Safety and Recalls
You may not list a product that is unlawful to sell. You are responsible for determining whether the product is subject to a recall or sale prohibition.
If an item has been recalled and applicable law prohibits its resale, you may not list or sell it through Gearave. If a legally recognized recall remedy has been completed and resale is lawful, your listing should accurately disclose relevant remediation where appropriate.
7. Prohibited Listings
You may not list stolen property, counterfeit goods, unlawfully obtained goods, recalled goods that cannot lawfully be sold, unsafe or prohibited products, products whose sale would violate law, items that infringe third-party intellectual-property rights, misleading or fraudulent listings, or items prohibited under additional Gearave policies.
Gearave may remove a listing if we reasonably believe it violates these rules.
8. Price
You are responsible for setting your asking price. Prices must not be intentionally misleading. If additional costs apply, you must clearly disclose material costs before the buyer commits to the transaction.
You may change a listing price while the item remains available unless you have already entered into a binding agreement that restricts you from doing so.
9. Availability and Listing Status
You must keep listing availability reasonably current. When an item is sold or is no longer available, update its status promptly.
Gearave may support statuses such as Available, Sold, Withdrawn, or Archived. Do not intentionally represent an unavailable item as available solely to generate traffic, messages, saves, leads, or engagement.
10. Saved Listings
A buyer saving or bookmarking your listing does not create a contract, reserve the item, guarantee a purchase, or require you to hold the item.
11. Wanted Requests
Gearave may permit buyers to publish Wanted requests. If you respond to a Wanted request through “I Have This,” messaging, or another Gearave feature, your offer is subject to the same accuracy, ownership, authenticity, safety, and legality obligations that apply to ordinary listings.
You may not falsely claim to possess an item requested in a Wanted post.
12. Communications With Buyers
Communicate accurately and respectfully. You may not misrepresent material transaction facts, impersonate another person, demand unnecessary sensitive personal information, use marketplace messaging for scams, send malware, threaten or harass users, or use deceptive payment instructions.
13. Local Meetup Transactions
For local transactions, sellers and buyers are responsible for arranging an appropriate meeting location. We recommend public locations, reasonable daylight or business hours when practical, inspecting the item before completing the transaction, avoiding unnecessary disclosure of home addresses or sensitive information, letting another person know where you are meeting, and ending the transaction if circumstances appear unsafe.
OUTRALLY does not supervise ordinary user-arranged exchanges.
14. Payment
Unless Gearave expressly offers a payment feature for a transaction, payment is arranged directly between buyer and seller. Gearave does not guarantee payment, chargeback protection, cash authenticity, transfer reversibility, or payment-provider performance.
Never rely on screenshots alone as proof that electronic funds have settled. If Gearave later introduces integrated payments, additional payment terms may apply.
15. Shipping
If you voluntarily agree to ship an item, you are responsible for accurately representing shipping terms, packaging the item appropriately, shipping within the time promised, providing legally required delay or cancellation options, and complying with applicable consumer-protection rules.
If Gearave later provides integrated shipping, additional terms may apply.
16. Returns and Refunds
Unless Gearave expressly offers a transaction-protection program, buyer and seller are responsible for agreeing on return and refund terms. However, a private agreement does not eliminate rights or obligations that applicable law does not allow the parties to waive.
You must not misrepresent a transaction as “final sale” in order to avoid legal obligations that actually apply.
17. Taxes, Licenses, and Business Obligations
You are responsible for determining whether your selling activity creates income-tax obligations, sales or use-tax obligations, business-license requirements, resale requirements, consumer-protection obligations, reporting obligations, or commercial seller obligations.
Gearave may collect or report information where required by law.
18. Seller Verification
Gearave may require additional verification from a seller where reasonably necessary to protect users, investigate fraud, verify identity, verify business information, verify authority to sell, comply with tax obligations, comply with marketplace transparency laws, satisfy payment-provider requirements, or comply with applicable law.
Verification may include requests for name, email, telephone number, business information, government-issued identification, tax information, payment or payout information, physical address, or certifications concerning accuracy. The information requested will depend on the feature and applicable legal requirements.
19. High-Volume and Commercial Sellers
Certain sellers may be subject to additional requirements because of transaction volume, business status, revenue, or applicable law.
Where required, Gearave may collect additional identifying information, verify seller information, require periodic recertification, display legally required seller information, provide consumers with reporting mechanisms, or restrict or suspend selling until required information is provided.
Gearave may apply reasonable verification standards that are more protective than minimum legal requirements where appropriate for safety or fraud prevention.
20. Retailers, Dealers, Pro Shops, and Business Sellers
Business sellers must accurately represent their business identity and comply with applicable laws governing advertising, pricing, warranties, consumer protection, taxes, fulfillment, returns, and product safety.
A business account or seller badge does not constitute a guarantee or endorsement by OUTRALLY unless explicitly stated otherwise.
21. Reviews and Reputation
If Gearave supports seller reviews, transaction ratings, or marketplace reputation, you may not post fake reviews, arrange fraudulent transactions to generate reviews, purchase positive reviews, threaten users to influence reviews, offer incentives conditioned on positive sentiment, manipulate the review system, or retaliate against users for good-faith reviews.
22. Marketplace Manipulation
You may not repeatedly duplicate listings to manipulate visibility, generate fake messages, create fake saves, fabricate transactions, coordinate deceptive marketplace activity, manipulate search or ranking systems, use bots or unauthorized automation, or create multiple accounts to evade limits or enforcement.
23. Intellectual Property
You must have the rights necessary to use all listing text, photographs, graphics, logos, and other content.
You may accurately identify genuine branded products for resale where legally permitted, but you may not imply that you are authorized, sponsored, endorsed, or affiliated with a brand when you are not.
24. Your Listing Content
You retain ownership of your listing content. The license you grant OUTRALLY for listing content is governed by the User Content section of the OUTRALLY Terms of Service and permits Gearave to display, host, format, search, distribute, moderate, and promote public listings as reasonably necessary to operate and market the marketplace.
25. Buyer-Seller Relationship
Unless expressly stated otherwise, the seller, not Gearave, sells the item; the buyer, not Gearave, purchases the item; Gearave is not a party to the agreement between buyer and seller; and Gearave does not take title to the item.
Nothing in this provision changes obligations imposed directly on Gearave by applicable law.
26. No Guarantee of Transaction
Gearave does not guarantee that your item will sell, a buyer will respond, a buyer has sufficient funds, a user will attend a meetup, a buyer will behave appropriately, or your desired price will be achieved.
27. Fraud and Suspicious Activity
You must not use Gearave to commit or facilitate fraud. We may investigate reports, request information, preserve records, restrict listings, restrict messaging, suspend marketplace access, suspend accounts, or cooperate with lawful investigations.
Users may report suspicious Gearave activity to info@gearave.com.
28. Cooperation With Safety or Legal Investigations
Where permitted or required by law, OUTRALLY may preserve or disclose relevant information in response to valid legal process, law-enforcement requests, fraud investigations, safety threats, intellectual-property claims, or marketplace compliance requirements.
Our handling of personal information remains subject to applicable law and our Privacy Policy.
29. Moderation
Gearave may review, reject, restrict, demote, suspend, archive, or remove listings where reasonably necessary to enforce these Seller Terms or the OUTRALLY Terms, protect users, address fraud, investigate reports, protect marketplace integrity, or comply with law.
A listing remaining visible does not mean that Gearave has independently verified ownership, authenticity, condition, safety, legality, or seller identity.
30. Seller Suspension
We may restrict or suspend selling privileges where required information is not provided, fraud is suspected, repeated policy violations occur, prohibited goods are listed, legal compliance requires suspension, or activity creates substantial marketplace or user risk.
Suspension of selling privileges does not necessarily require suspension from all OUTRALLY Services.
31. Disputes Between Buyers and Sellers
Unless Gearave expressly offers a dispute-resolution or transaction-protection program for a particular transaction, buyers and sellers are responsible for resolving transaction disputes between themselves.
Users may still report fraud, prohibited goods, counterfeit items, harassment, threats, impersonation, or policy violations.
32. Limitation of Gearave’s Marketplace Role
The disclaimers and limitations of liability in the OUTRALLY Terms of Service apply to Gearave selling activity. Nothing in these Seller Terms limits liability or consumer rights that cannot lawfully be limited.
33. Indemnification
The indemnification provisions in the OUTRALLY Terms of Service apply to seller activity. To the extent permitted by law, this includes third-party claims arising from your listing, item, transaction, infringement of another person’s rights, unlawful selling activity, or material violation of these Seller Terms.
34. Changes to Seller Terms
We may update these Seller Terms as Gearave, marketplace functionality, or legal requirements change. The current version will contain an effective date or version number.
If a material change requires renewed agreement, we may require you to review and accept the revised Seller Terms before creating or managing new listings.
35. Electronic Acceptance
Acceptance through a checkbox, button, account flow, or other electronic method constitutes acceptance to the extent permitted by law.
Gearave may retain records showing the account accepting, Seller Terms version, acceptance date and time, acceptance surface or application, and other reasonably necessary audit information.
36. Incorporation of OUTRALLY Terms
The following provisions of the OUTRALLY Terms of Service are incorporated into these Seller Terms, including account rules, acceptable use, intellectual property, user content, privacy, suspension and termination, disclaimers, limitation of liability, indemnification, governing law, severability, and changes to terms.
